Audio Visual Tariffs
The Copyright Society of Botswana (COSBOTS) is the Collective Management Organization in Botswana; incorporated in 2008 as a Private Company Limited by Guarantee. COSBOTS is mandated by the Copyright and Neighbouring Rights Act CAP 68:02 to, among others, license and collect royalties from users of protected works to distribute to copyright owners, as well as setting royalties in accordance with international standards.
The following tariffs shall determine the royalties to be collected by the Copyright Society of Botswana (COSBOTS) on behalf of members and affiliated organizations for:
a. Broadcast,
b. Public performance, and
c. Communication to the public of Audio-Visual Works.
The tariffs shall fix the remuneration payable to creators, performers and/or producers of Audio-Visual Works and/or fixations communicated to the public or otherwise exploited, depending on the modalities of such use, in respect of AudioVisual Works and Fixations of both national and foreign origin as outlined in the Constitution of COSBOTS and the Copyright and Neighbouring Rights Act CAP 68:02.
The distribution of royalties for members of COSBOTS and for members of sister societies shall be carried out in accordance with the Distribution Rules of COSBOTS.
Tariff (AV-BR) Broadcasters
These tariffs applies to the communication to the public of Audio-Visual Works and/or Fixations carried out by Broadcasters. For the purposes of these tariffs, “Broadcast” shall mean any service of transmissions of fixations of moving images, with or without sound, which take place over wires, wireless or other means provided by material substance and intended for reception by specific
members of the public. The Royalty fee for any television broadcast are calculated by reference to their gross annual revenue or gross operating budget.

Tariff (AV-STV) for Subscription, Transactional Video Streaming, On –
Demand Platforms and Similar platforms
This annual tariff applies to Communication to Public of Audio-Visual Works and/or Fixations based on where there is a fee charged to view or access the services or are otherwise commercialising the stream. The Royalty Fee for Subscriptions and/or Video Streaming will be calculated 5.5% of Gross Annual Revenue generated from Subscriptions and/or Views.
Tariff (AV-CVK) Cinema halls, Outdoor Cinemas, Video Rental Shops and
Kiosks
This tariff applies to the communication to the public of Audio-Visual Works and/or Fixations at Cinemas, Video Rental Shops, Kiosks and similar premises by means of Television, Video Projector, DVD players or any other transmitting apparatus only for the purposes of communicating to the public.

works.

This annual tariff applies to the performance of Audio-Visual Works and/or Fixations at in Hotels, Motels, Lodges, Guesthouses, banqueting suites, and similar multiroomed premises and similar places. This tariff is not dependent on the hotel room occupancy and will apply whether
the accommodation establishment is filled to capacity or not. Audio-Visual works include cinematograph films, movies, soaps, dramas, series,
and similar in TV programs and TV channels.
